Any one has any contacts there? My previous employer is refusing to pay me the money he owes me. I am gettin pretty pissed. Any computer whizz here, maybe we can go on his company facebook page or website and let everyone know what a thief he is?

How much does he owe you?

You can claim up to R12,000 through the small claims court. Download the form here www.justice.gov.za/scc/scc.htm

It's pretty easy, you fill in the form yourself and have him sign as acceptance. He then has 2 weeks to pay you. If he doesn't, you take the form to the small claims court and they'll subpoena him.

If he owes you more than R12,000 you can still claim R12,000 from him through the small claims court in the interim, and pursue the rest through other avenues.

If he owes you a heck of a lot, get a lawyer or contact the department of labour directly. Don't know if the CCMA will be able to help, but check that out too.

CCMA helped me out quite a bit the only thing with them is when you were dismissed or resigned
Etc the case shouldn't be filed more than 30 days later they like to make examples of companies went home after being unfairly dismissed and not receiving my last sallary. When court came they had to cough up 3months salary as well as had to pay my labour representative and r10k up front

How sure are you that you can claim through the SCC for labour issues? I'm strongly under the impression that you cannot do this and that why the CCMA was establishes.

Not sure about that, the website doesn't list labour issues as an exclusion? Can't hurt to find out though. I used that form to get money someone owed me for a gig I did for them. They immediately paid, without the whole thing going to court. So I suppose at the very least it serves as a handy tool to scare someone into paying you. ;)

But yes, I suppose the CCMA is more relevant to his situation.

CCMA will be the cheapest and quickest solution without the hassels of going to court.

Wayne, just read your contract of employment before consulting the CCMA. I lost my job at end November 2010 and tried to get the CCMA to help. The Zimbabwean fuck that I worked for put a clause in my contract that stipulates that when he no longer needs me (couldn't afford my salary any longer)and he gives you notice then you have to acquire private arbitration(Which could cost anywhere between R8000 and R35000 per day). I went to the CCMA twice but they could do shit. Personally I think he had inside there as well as with Dept. Public Works where he makes millions.....

Thanks for the replies guys. @ north, this guy is a prick, his contracts are actually illegal cos he actually used to state that "you will not be paid for public holidays" he does everything he can to lie, cheat and steal. He has went one better and now is actually demanding money from me for a broken glass stand(somethin that happened 2months before i left) I sent the mail to labour dept and got a response that they are gonna assign an inspector to it.
