Gym listed me with a Default on my credit report

Hi Guys,

i hope you all are well?

I was hoping that you guys can give me some advice please, i was listed with a Default on my name with Bad debt written of from a local gym i joined years ago, but the thing is this was about 3-4 years ago and i stopped going to gym there also about 4 years ago because they were renovating and i was also without a job that time being a student.

for years i never heard about them and in the interim i have been training at virgin active. but the gym at the time is now re named to another name and i really want to get this default of my name. i have disputed this Default with transunion but i now want to get all my ducks in a row and get rid of this.

any advice would be appreciated guys.

Howsit,

As far as I know, A default is logged on the system at the credit bureaux for two years and is then automatically removed.

so basically you should be in the clear for about 2 years already.

If they failed to make contact with you within a given time (few years), then you can try and fight a stupid fights. All they need to prove is that they tried to call you every two now and then and then you stuffed anyway.

Renovating or you lost your job, that suck balls, but fact is they dont care and you didn't pay. Go settle your account and send the receipt of proof of payment to clear your name.

Thanks Garth, and thanks Oupa,

I have approached a lawyer in the mean time and i have logged a dispute with transunion on the fact that the debt has prescribed and also on the fact that there was no correspondance from their side what so ever which is a requirement of the national credit act, so now transunion will put an investigation in place and if there is an error found regarding the two facts that i am disputing it on the default falls away, and also with the help of some lawyers i am sure it will be sorted.

I spoke to the manager of the club and he cant even assure me fhat they still have the contract which i originally opened up with them, and also by reading the hello peter posts about this gym it looks like a lot of people are complaining about the same thing.

Good advice gentlemen.

Well done to you Christian and taking steps forward to getting this matter seen to and concluded. I think a lot of companies really do have a manner of trying to strong arm people. VA tried that stunt after I changed gyms, perhaps bad communication on their part but to come two years later with a claim of owing money when such does not exist did not go down well. Fortunately I did not have to employ the services of any lawyers but did have to put cancel the direct debit they insisted on trying to enforce and let them know where I stood. I was grateful I got through to someone with some ounce of common sense.
